TERMS OF SERVICE

These Terms of Service govern your use of the James Augustine marketplace website and all products purchased through it. By accessing the site or purchasing products, you agree to these terms.

1. ACCEPTANCE OF TERMS

By using this website and marketplace, you confirm you are at least 18 years old and have the legal capacity to enter into binding agreements. If you are purchasing on behalf of a business, you represent that you have authority to bind that business to these terms.

2. PRODUCTS AND PURCHASES

All products sold on this marketplace are digital goods. Upon successful payment, you receive a non-exclusive, non-transferable license to use the purchased product according to the License Agreement. Prices are listed in US Dollar ($). We reserve the right to change prices at any time without notice, but your purchase price is locked at time of transaction.

3. USER ACCOUNTS

You must create an account to purchase products. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at hello@xofa-technology.com if you suspect unauthorized account use.

4. INTELLECTUAL PROPERTY

All products, code, designs, documentation, and content on this site are the intellectual property of James Augustine unless otherwise noted. Your license to use purchased products does not transfer any ownership rights. You may not resell, redistribute, or sublicense the original product files.

5. PROHIBITED USES

• Reselling, redistributing, or sublicensing product files as your own
• Using products to create competing marketplaces or template stores
• Removing copyright notices or attribution from product files
• Using the site for unlawful purposes or in violation of applicable regulations
• Attempting to gain unauthorized access to our systems

6. DISCLAIMER OF WARRANTIES

Products are provided "as is" without warranty of any kind. While we strive for high quality and test all products thoroughly, we do not warrant that products will be error-free or suitable for your specific use case. We are not responsible for any damages arising from the use of our products beyond the purchase price paid.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by law, James Augustine's total liability for any claim arising from these terms or use of our products shall not exceed the amount you paid for the specific product giving rise to the claim.

8. GOVERNING LAW

These terms are governed by the laws of the Federal Republic of Nigeria. Disputes will be resolved through binding arbitration in Lagos, Nigeria, except where prohibited by applicable law.

9. CHANGES TO TERMS

We may update these terms at any time. Continued use of the site after changes constitutes acceptance of the new terms. Material changes will be communicated by email to registered users.
